Open the letter, verify that this debt is yours. If you have received a letter a bailiff a bailiff will be able to visit after 7 days. Do not panic If a bailiff does turn up, you do not have to let them in and they cannot force entry. make sure all your doors and windows are locked.
The bailiffs have the powers to repossess your possessions and sell them and give your creditors the proceeds. Bailiffs can look through the window or outside of the property to log items for repossession, so there is a risk if your curtains are open or there are vehicles outside.
There are several different types of bailiffs. They work on behalf of the courts to collect unpaid debts.
- High court enforcement officers – These are bailiffs who work on behalf of the high court.
- Certificated enforcement agents – These bailiffs are employed privately by a firm, they usually collect council tax arrears, HMRC debts, and unpaid parking fines.
- County Court and Family Court – These bailiffs work for the county court to collect unpaid county court judgments.
- Civilian or Approved enforcement agents – The enforce magistrates’ court fines and warrants for arrests.
If you are eligible, an IVA could be the option to get you out of debt and stop bailiffs visiting your property, with the exception of unpaid court fines, student loans and child support. All other debts, such as, council tax and parking tickets can be paid off using an IVA and if approved your Insolvency Practitioner can contact the bailiffs to stop the action.
